definitions
*
for the purpose of this agreement, “artist” refers to matthew j viator. “client” refers to the named individual in the questionnaire on the form above.
I understand and accept these terms.
consultation
*
each commission begins with a complimentary consultation to understand the scope of the work, including style, detail, cost, and time frame. this conversation ensures clarity of vision and expectations before any deposit is made.
I understand and accept these terms.
pricing
*
each commission is unique, and a final price will be supplied on the finalized agreement paperwork at the conclusion of the consultation. acceptance of this price is required and deposit paid against this balance before any work begins.
I understand and accept these terms.
reference photography
*
commissions require a photo shoot conducted by the artist. the shoot provides a variety of images from multiple angles to serve as accurate source material. this is a minimal additional cost and is scheduled at the client’s convenience.
I understand and accept these terms.
deposit & payment
*
a non-refundable deposit of 50% of the agreed commission price is required to initiate the work. the balance is due upon completion, prior to delivery or shipment of the final piece. the deposit applies only to the specific commission described in the consultation and is not transferable to other projects.
I understand and accept these terms.
artistic style
*
the artist’s drawing style is consistent and identifiable. commissioning a work implies acceptance of this style. dissatisfaction based solely on subjective preference does not constitute grounds for non-payment or refund.
I understand and accept these terms.
framing
*
custom framing is separate from this agreement and can be arranged at the client’s request. a 20% service premium is added to the frame’s base cost to cover selection, preparation, and assembly. framing requires a minimum of two calendar weeks in addition to shipping and handling.
I understand and accept these terms.
shipping & delivery
*
all shipping, insurance, and handling costs are the responsibility of the client. these charges will be invoiced separately and must be paid in full prior to shipment. clients may avoid shipping costs by arranging to pick up the completed work directly from the studio. for works collected from the studio, the client agrees to collect the completed work within 30 days of notification that it is ready. uncollected works may incur storage fees. once the artwork has been delivered or collected, the artist is not responsible for damage, theft, or deterioration arising from handling, transport, or storage.
I understand accept these terms.
timeline
*
commissions require a minimum of 90 days for completion. estimated timelines will be discussed during consultation. while every effort is made to meet the agreed schedule, artwork is a creative process and timing may vary. clients will be updated as progress is made.
I understand accept these terms.
scope changes
*
any changes requested by the client after the consultation that materially alter the scope of the commission will result in additional charges and an adjusted timeline. such changes will be documented in writing and agreed upon before further work proceeds.
I understand and accept these terms.
final acceptance
*
upon delivery, the commission is considered complete and accepted. any further modifications will constitute a new commission agreement.
I understand and accept these terms.
force majeure
*
the artist shall not be liable for delays or failure to complete the work due to circumstances beyond reasonable control, including illness, supply shortages, or force majeure events. in such cases, the timeline will be reasonably extended until completion. the deposit remains non-refundable.
I understand and accept these terms.
copyright & reproduction
*
the artist retains all copyright and reproduction rights to commissioned works unless otherwise agreed in writing. the client receives the original work (or custom print) for personal display, not for reproduction or resale.
I understand and accept these terms.
cancellation
*
if a client cancels after work has begun, the deposit is forfeited. if the artist must cancel, all monies paid will be refunded in full.
I understand and accept these terms.
acceptance
*
each of these terms has been outlined and accepted. additionally, when the client signs the final commission agreement, the client acknowledges and accepts these terms, based on the finalized consultation. a deposit made by check, venmo, or zelle constitutes further acceptance of the final commission agreement.
I understand and accept these terms.
